What is TPD?
The Tobacco Products Directive (TPD) is a regulation implemented in the UK through the Tobacco and Related Products Regulations 2016, sets forth specific standards for the manufacture, presentation, and sale of tobacco-related products, including e-cigarettes and e-liquids. TPD aims to improve product safety, ensure transparent consumer information, and reduce the risks associated with vaping products.
The directive specifies the standards for packaging, nicotine content, tank capacities, and testing requirements. It also mandates that manufacturers notify their products to the MHRA before they are sold in the UK.
Why does it apply to vaping?
E-cigarettes and e-liquids are included in the TPD because they contain nicotine, a substance derived from tobacco plants. While vaping products do not include tobacco itself, the regulation ensures that products remain safe for consumers.
By regulating key aspects such as nicotine strength and bottle capacities, TPD protects consumers from potential misuse and ensures clarity on product labelling.
When did it come into Effect?
The TPD was introduced in May 2014 and became law in the UK on 20 May 2016. Since then, all e-cigarette products sold in the UK must comply with these regulations. Non-compliant products cannot be legally sold, and those that do not meet TPD standards have been removed from the market.
What are the regulations?
The TPD outlines several requirements for vaping products. These include:
- E-liquid containers: Must not exceed 10ml in size for nicotine-containing liquids.
- Nicotine strength: Limited to a maximum of 20mg/ml (2%).
- Tank capacity: Vape tanks and cartridges cannot exceed 2ml.
- Packaging: Child-resistant and tamper-evident packaging is mandatory.
- Product safety: No promotional claims suggesting health benefits are allowed.
- MHRA notification: All products must be tested and submitted to the MHRA before sale
